本利用規約（以下「本規約」）は、PatchMemo GX（以下「本アプリ」）の利用条件を定めるものです。 ユーザーの皆様には、本規約に同意いただいた上で、本アプリをご利用いただきます。

本アプリをダウンロード、インストール、または使用することにより、 ユーザーは本規約に同意したものとみなされます。

運営者は、ユーザーに対し、本規約に従うことを条件として、 本アプリを個人的かつ非商業的な目的で使用するための、 非独占的、譲渡不能、取消可能なライセンスを付与します。

ユーザーは以下の行為を行ってはなりません。

• 本アプリの複製、改変、配布、販売、貸与
• 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル
• 本アプリのソースコードの抽出を試みる行為
• 本アプリに基づく二次的著作物の作成

本アプリは、13歳以上の方を対象としています。13歳未満の方は、保護者の同意を得た上でご利用ください。

ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。

• 法令または公序良俗に違反する行為
• 犯罪行為に関連する行為
• 本アプリのサーバーまたはネットワークの機能を破壊・妨害する行為
• 本アプリの運営を妨害するおそれのある行為
• 不正アクセスをする行為
• 反社会的勢力に対して直接または間接に利益を供与する行為
• その他、運営者が不適切と判断する行為

本アプリでは、以下の有料プランを提供しています。

• PatchMemo GX Pro（月額）: ¥200/月
• PatchMemo GX Pro（買い切り）: ¥1,800

本アプリおよびそのコンテンツ（テキスト、画像、ロゴ、アイコン、ソフトウェア等）に関する 著作権、商標権、その他の知的財産権は、運営者または正当な権利者に帰属します。

本規約に明示的に定められた場合を除き、ユーザーはこれらの知的財産を使用、複製、 配布する権利を有しません。

本アプリは「現状有姿」で提供されます。運営者は、本アプリの完全性、正確性、 信頼性、適合性、または特定目的への適合性について、明示または黙示を問わず、 いかなる保証も行いません。

運営者は、本アプリの使用または使用不能に起因する直接的、間接的、偶発的、 特別、結果的、または懲罰的な損害について、一切の責任を負いません。

本アプリが第三者のサービス（AI処理サービス等）を利用している場合、 当該第三者サービスの可用性、正確性、または信頼性について、運営者は保証しません。

適用法令で許容される最大限の範囲において、本アプリに関連して生じた いかなる損害についても、運営者の責任は、ユーザーが本アプリに支払った 金額を上限とします。

ただし、運営者の故意または重大な過失による場合はこの限りではありません。

ユーザーは、本アプリをアンインストールすることにより、 いつでも本規約に基づく契約を終了することができます。

運営者は、ユーザーが本規約に違反した場合、事前の通知なく、 ユーザーの本アプリへのアクセスを停止または終了することができます。

契約終了後も、知的財産権、免責事項、責任制限、準拠法に関する条項は 引き続き有効に存続します。

本規約は、日本法に準拠し、日本法に従って解釈されるものとします。

本規約に関連して生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

運営者は、必要に応じて本規約を変更することができます。 重要な変更がある場合は、本ページにて通知します。

変更後も本アプリの利用を継続した場合、ユーザーは変更後の規約に 同意したものとみなされます。

These Terms of Use (the “Terms”) set forth the conditions for using PatchMemo GX (the “App”). By using the App, you agree to be bound by these Terms.

By downloading, installing, or using the App, you are deemed to have agreed to these Terms.

Subject to your compliance with these Terms, the developer grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You shall not:

• Copy, modify, distribute, sell, or lease the App
• Reverse engineer, decompile, or disassemble the App
• Attempt to extract the source code of the App
• Create derivative works based on the App

The App is intended for users aged 13 and older. Users under 13 must obtain parental consent before using the App.

Users shall not engage in the following activities while using the App:

• Actions that violate laws or public order and morals
• Actions related to criminal activity
• Actions that destroy or interfere with the functionality of the app's servers or networks
• Actions that may interfere with the operation of the app
• Unauthorized access attempts
• Actions that directly or indirectly provide benefits to antisocial forces
• Any other actions deemed inappropriate by the developer

The App offers the following paid plans:

• PatchMemo GX Pro (Monthly): $2.49/month
• PatchMemo GX Pro (Lifetime): $22.99

All intellectual property rights in the App and its content (text, images, logos, icons, software, etc.) belong to the developer or their rightful owners.

Except as expressly provided in these Terms, you have no right to use, copy, or distribute any intellectual property.

The App is provided “as is.” The developer makes no warranties, express or implied, regarding the completeness, accuracy, reliability, suitability, or fitness for a particular purpose of the App.

The developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the App.

If the App utilizes third-party services, the developer does not guarantee the availability, accuracy, or reliability of such third-party services.

To the maximum extent permitted by applicable law, the developer's liability for any damages related to the App shall be limited to the amount you paid for the App.

This limitation does not apply in cases of willful misconduct or gross negligence by the developer.

You may terminate your agreement under these Terms at any time by uninstalling the App.

The developer may suspend or terminate your access to the App without prior notice if you violate these Terms.

The provisions regarding intellectual property, disclaimer, limitation of liability, and governing law shall survive termination.

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

The developer may modify these Terms as necessary. Significant changes will be notified on this page.

By continuing to use the App after changes are made, you agree to be bound by the revised Terms.
